These terms set out the procedure for ordering, paying and claiming the products offered on this site. The “TERRE” web pages can be used for your private use without any charge for use, subject to the following terms and conditions.

Trades “TERRE”, owner Željko Fero reserves the right to change these terms and conditions. All changes will be applied to the use of the website www.terre.hr. The buyer is responsible for the accuracy and completeness of the data entered when purchasing. Services provided by www.terre.hr. The internet store does not include the costs you incur by using computer equipment and services to access our site. The craft of “TERRE” Mr Željko Fero is not liable for the costs of telephone, internet traffic or any other costs that may arise.

Trademark “TERRE” reserves the right at any time, without prior notice, if it considers it necessary, to abolish or modify any of the terms and conditions of use of the Website and / or the Statement of Confidentiality. Therefore, “TERRE” Crafts advises users to periodically re-read the information contained in the Terms of Use and Privacy Statement and to be informed of any changes.
Obligation and duty of the user is to use the website www.terre.hr exclusively in accordance with the regulations of the Republic of Croatia, as well as with the general moral and ethical principles.

The complaint must include: name, surname, address and email address for reply. We will respond to your written complaint within 15 days of receiving the complaint.

DISPUTE RESOLUTION

Any disputes between the Seller and the Buyer will be solved by agreement and by peaceful means, otherwise the Court in Buje shall be competent with the application of the laws and regulations of the Republic of Croatia.

SECURITY OF DATA AVAILABLE FOR PURCHASE

Your contact information, e-mail, phone and mobile and address will be used solely for the purpose of checking, delivering and realizing your order and we will not provide this to third parties.

PAYMENT SECURITY

For secure authorization payment on our site we use IKB Umag services.

ORDERING
The buyer orders the product or products through an electronic order form.
A customer is considered to be any person who electronically orders at least one product, fill in the requested information and send the order.
All prices are quoted in Croatian national currency, Croatian kuna (kn) and in EUR (€), with VAT.
The goods are ordered electronically, by pressing a particular product and saving it in the cart. Goods are deemed to be ordered at the time the buyer chooses and confirms the payment method and makes the payment of the goods.

REVOCATION ORDER BY – Trade “TERRE” vl. Željko Fero

We reserve the right to exclude (in whole or in part) from the execution of orders in the following cases:
– When stocks are out of the ordered products
– When there is an obvious error in the price list
– If the order has not been met in accordance with the general terms or conditions
– If we find an increased risk of unpaid at the customer.
In all these and similar cases, after we have determined the irregularity, we will immediately notify you by phone or email of any possible deviation from the contract on our part.

CANCELLATION OR CHANGING THE ORDER BY THE CUSTOMER

You can cancel or change your order without charge if your goods have not been dispatched from the warehouse.

Payments are made by the general payer to the account of “TERRE” through the transaction account

DELIVERY

We deliver on the territory of the Republic of Croatia and most of the European Union countries.
Delivery of available products is done by DPD Croatia.
Orders will be delivered according to the usual terms and conditions of DPD Croatia.
The ordered product can be picked up by a personal arrival at our warehouse in Novigrad, at ul.Mirna 5.
Delivery is from door to door to every address.
The delivery cost is calculated automatically on the shopping cart, depending on the weight of the package and delivery country.
The packaging price is included in the cost of shipping and packaging that is calculated in the cart prior to payment. When purchasing the goods, the buyer is obliged to check the condition of the consignment and, in case of damage, immediately report the product to the deliverer. The Seller waives any responsibility for any damage that might arise during the delivery.
If the buyer does not receive the goods, or the delivery note, after being sent, at the expected time, the buyer has the right to notify the seller in order to take the actions of finding the shipment or to send the replacement shipment.
If the buyer refuses to accept the goods ordered by the seller, the seller has the right to request from the buyer the reimbursement of all costs related to the delivery.
The seller agrees to send the shipment to the buyer at the moment he receives proof that the goods have been paid. Upon receipt of this confirmation, the seller agrees to send the shipment within 5 (five) working days.
After the deliverer (delivery company) signs the shipment by the seller, the seller is no longer responsible for further delivery and any delays and problems that may arise in connection with further manipulation and delivery of the goods.

COMPLAINTS

The user within 14 (fourteen) calendar days from the date of delivery of the product has the right to claim the purchased product or return the product if the goods are picked up due to defects in the products or the products delivered are defective. Trader “TERRE” will refund the funds to the account that the User has stated in the application itself or to replace the product with a new one within 30 (thirty) days from the date of receipt of the returned product on the basis of a justified request for refund or replacement.
The user announces the return of the purchased products by sending an e-mail to info@terre.hr with providing information about the purchase and complaint. The return of delivered products shall be by delivery to the address at which the Customer is notified. The Customer shall bear the cost of the product return.
The customer is obliged to return the delivered goods in the condition they have been delivered to him in the original packaging (the merchandise package in which the goods are delivered).
If it is undoubtedly determined that a product complaint is unjustified (eg an open or used product) or that the defect of the ordered product has been due to inadequate handling or use then the “TERRE” craft is not obliged to make a refund or supply the replacement product. The advertised product will be returned to the user at his expense with a written explanation of the reasons for not accepting a refund or replacement request.
If there is an error when packing the ordered products, and the buyer has not received the ordered product but somebody else, please report by emailing us at info@terre.hr within 8 (eight) days of the receipt of the shipment. In such case, the User returns the wrong product at the expense of “TERRE”, which is obliged to deliver the ordered product or to make a refund (according to the User’s request) within 15 (fifteen) days of receipt of the incorrectly delivered item.
If the Customer has not received the ordered and paid product, he / she must report it within 8 (eight) calendar days of the expected arrival date of the ordered product by sending an e-mail to info@terre.hr. Craft “TERRE” is obliged to determine what happened with the advertised shipment within that time, and inform the customer about further complaint resolution.
In the event that a particular product specifies the special conditions for the return of the goods, then special conditions apply.

In the case of hidden shortcomings, which were not visible when taking over, the provisions of the Mandatory Relationship Act shall apply.

The consumer (mentioned only applies to natural persons who purchase items for purposes beyond their economic value) has the right within 14 days of the takeover of the article to notify the seller of the waiver of the contract without the need to state the reasons for his decision. The term of one-off termination of the contract shall be 14 days from the day you or the third person you have designated, and who is not the carrier, the goods that are the subject of the contract.
If you unilaterally terminate this Agreement, we will refund the money we received from you, including delivery charges, without delay, and within 14 days from the day you received your decision to unilaterally terminate your contract.
Refunds will be made in the same way that you made your payment. In case you otherwise agree to a refund, you will not incur any costs in return. Money can be repaid after the goods are returned.
It is deemed that you have fulfilled your obligation to return the goods in time if you send or deliver the goods to the seller before the expiry of the above deadline (no later than 14 days after the receipt of your decision on unilateral termination of the contract).
Direct costs of reimbursement are borne by the customer himself and in the event of the right to unilaterally terminate the contract and in the event that the goods can not be returned by post due to their nature in the usual manner.
Refund of money will be made after the goods are returned, by payment to your bank account.
You are responsible for any impairment of the goods resulting from the handling of the goods, except for what was necessary to determine the nature, characteristics and functionality of the goods.
The consumer item must be returned indelibly and in an unchanged quantity unless the item is destroyed, corrupted, lost or reduced its quantity, and the above is not the wrong of the consumer.
The expense charged to the consumer if the contract is canceled is the expense of returning the item.
The consumer has no right to waive the contract if the subject of the contract is drawn up in accordance with the detailed instructions of the consumer and adapted to his / her personal needs.
In order to be eligible for the unilateral termination of this Agreement, you must notify us of your decision before the expiration of the deadline and this by an unambiguous statement sent by post or by email, specifying your name, address, telephone number or other email address.

A copy of the one-off termination contract form on our website can be sent to our email address: info@terre.hr. The receipt of the notification of the unilateral termination of the contract will be sent to you, without delay, by electronic mail.
